GENERAL TERMS & CONDITIONS

BYLAW / PERMITS

It is responsibility of the Purchaser to ensure all bylaw requirements are met through the local municipality of where the structure will be built. PacRim Log Structures Inc. will not be held liable for failure to comply with local building codes or bylaws. PacRim Log Structures is not authorized, nor responsible or liable for, to provide advice on building permits, bylaws, setbacks, lot lines, BC Building Codes or CSA standards.

CONSTRUCTION

PacRim Log Structures will not be held liable for any issue that may arise due to the Purchaser constructing their own unit, and as such may not be able to honour manufacturer’s warranty.

We strongly recommend hiring an experienced carpenter to perform all scopes of work provided for this project due to the complexity of the unit construction and additional finishing required. PacRim Log Structures will not be held liable for any instances caused by inadequate labour performed. PacRim Log Structures is unable to provide assembly instructions for any third-party materials provided (such as Roofing, Insulation, Base Materials). PacRim Log Structures does not keep a certified carpenter on staff to assist with building questions, however our office staff do the best we can to assist with construction issues over the phone as far as our knowledge will allow. As our office staff is not fully trained on the construction of these kits, or on general carpentry practices, we cannot guarantee that we can troubleshoot over the phone and may need to hire an hourly carpenter to do a site visit to assist you in the building process. We strongly encourage you hire an experience carpenter to construct your kit for this reason. 

WARRANTY

Any material purchased or provided by PacRim Log Structures from a third-party supplier will be subject to the warranty provided by that supplier. There will be no warranty on labour or materials provided by The Purchaser. PacRim Log Structures will not be held liable for damages to a unit caused by labour or materials provided by the Purchaser.

Products purchased from PacRim manufacturer are warrantied for a period of 5 years, calculated from the year shown on the identification plate attached to each structure. The warranty covers: seal failures in glass, hardware, thru splitting of wall logs, and any defective components produced that cannot be used for assembly. Items not covered include the following: Any inherent features of wood such as checking, warping, twisting, natural colour variations in wood; damage or deterioration caused due to lack of sealers or paints; defects caused by faulty installation, inadequate foundations, natural drying of wood, knots that do not affect the structure made by anyone other than the manufacturer. This warranty shall cover the cost of replacement parts only.

All warranty items are to be documented and provided to PacRim Log Structures through form of photo or video, showing the warranty detail in both close up and wide shot form. Warranties will not be scheduled until photos have been provided to PacRim Log Structures, and/or a member of PacRim has visited customer site to discuss warranty items and action plan. 

Purchaser is responsible for regular maintenance of their purchased unit, and has acknowledged that PacRim Log Structures will not be held liable for failure to perform regular maintenance. Failure to properly maintain purchased unit may void manufacturer’s warranty.

PAYMENTS

All products that ARE NOT IN STOCK will require a 50% Deposit Payment prior to ordering of the unit. If the unit is in stock, we require a 100% payment to reserve or purchase. The Purchaser’s unit will not be ordered until an initial payment has been received by PacRim Log Structures Inc. All additional material including insulation material, foundation material, and roofing material will require 100% payment prior to ordering from supplier.

 Invoice balances on reserved units are to be paid in full within 7 days of unit arrival at PacRim Log Structures Nanaimo location. Invoices that are not paid in full within 7 days are subject to lost reservation and the potential re-sale of this unit.

 Unit and all additional material must be fully paid for prior to leaving PacRim Log Structures Inc. at 1985 South Wellington Rd., Nanaimo, B.C., V9X 1R4.

Payments for all material, labour and services are to be paid directly to PacRim Log Structures Inc. through the form of: Personalized Cheque, Cash, Credit Card, Interac Debit, or Money Order. A receipt of payment will be issued to The Purchaser upon each payment.

CONSEQUENTIAL DAMAGES

Production time of this unit is dependant on the current manufacturing time at the factory and is not the responsibility of PacRim Log Structures Inc. A representative of PacRim Log Structures Inc. will communicate with the Purchaser regarding this ordering process when applicable during stated business hours and will provide any technical drawings or assembly instructions needed to the Purchaser upon purchase.

PacRim Log Structures will not be held liable for delay in shipment times due to unforeseen circumstances that are out of the control of PacRim Log Structures. A representative of PacRim will communicate with Purchaser as per information provided to PacRim as PacRim deems necessary.

PacRim Log Structures will not be held liable for consequential damages.

 If The Purchaser is picking up their purchased unit(s) and/or material, these products will be loaded by PacRim Log Structures onto/into The Purchaser’s vehicle. The Purchaser is responsible to secure the unit and/or material safely and accurately into/onto their vehicle of choice, prior to leaving PacRim Log Structures Inc. property. PacRim Log Structures Inc. will not be held liable for any damage or injury that may occur due to improper loading and securing of any purchased products.

 PacRim Log Structures will not be held liable for any damage incurred to a purchased unit while it is in our possession for any period over 30 days. Damage includes, but is not limited to: weather damage, physical damage, or otherwise. As our property does not have the capacity, nor enclosed storage facilities for long term storage of customer units, we are unable to guarantee the safety and protection from outside elements, weather, internal operations, or aspects out of our control.

REFUNDS

If a client has paid a deposit on an item that is NOT IN STOCK and terminates contract before or after the requested product has arrived on site a 50% refund on the total deposit amount will be returned and a 50% termination fee will not be refunded.   Refunds or return of payment are offered on in-stock items (as long as the item is still in PacRim possession) within 30 days of original purchase date on 100% of the original invoice amount less any costs or expenses incurred by PacRim including but limited to the the cost of any additional materials requested, metal or shingle roofing materials, or any other additional cost or expense that was incurred by PacRim on behalf of the intended purchaser.

Purchaser is responsible for notifying PacRim Log Structures of any cancelations of their unit and/or material packages. PacRim Log Structures will not be held liable for failure to communicate cancelation request by Customer. There will be no refund of payment on special order products, before or after production or ordering, including pre-fabricated kits, metal or shingle roofing packages, insulation or base material packages, or any other additional material package as requested by customer.

There will be no refund of initial payment on a 70mm (2 3/4″) wall thickness unit once the order has been submitted for production. There will be no refund of payments made on any custom order once submitted for production, or ordered from the factory. 

There will be no refunds on unit packages or materials once a package has been opened by customer, or material has been installed, cut, or altered in any way that would deem this material unfit to resell or reuse. There will be no refunds for labour performed, or delivery charges.


PURCHASE OF DISPLAY UNIT – TERMS & CONDITIONS

CONSTRUCTION / SITE PREP

If the Purchaser is preparing their own site preparations, foundation and/or wood floor joist system for their unit, PacRim Log Structures will not be held liable for any affect this site preparation, base or foundation has on the structural integrity of the unit.  

The Purchaser hereby agrees that PacRim Log Structures will not be held liable for any issue that may arise due to the Purchaser preparing their own site preparations, foundation and/or base for the unit.

WARRANTY

Display unit is sold AS IS, as shown during offer acceptance, and will not be covered by any warranty (manufacturer, retailer, or otherwise). PacRim Log Structures will not be held responsible for any deficiencies created or caused by transport.

Any material purchased or provided by PacRim Log Structures from a third-party supplier will be subject to the warranty provided by that supplier. There will be no warranty on labour or materials provided by The Purchaser. PacRim Log Structures will not be held liable for damages to a unit caused by labour or materials provided by the Purchaser.

PacRim Log Structures will not be held liable for any deficiency work once the unit has left PacRim property and ownership, unless otherwise expressed by a representative of PacRim Log Structures.  

CONSEQUENTIAL DAMAGES

 PacRim Log Structures will not be held liable for consequential damages.

PacRim Log Structures will not be held liable for any damage caused to the unit during transport. Customer is aware that the transport of a constructed unit may result in the structure to become out of alignment and may need attention during and after transport/offload to ensure unit is fully level and structurally safe. PacRim Log Structures will not be held liable for any damages or injury that may be caused once the display unit has left PacRim property and ownership.

The Purchaser, or Purchaser’s hired contractor, is responsible to secure the unit and/or material safely and accurately into/onto their vehicle of choice, prior to leaving PacRim Log Structures Inc. property. PacRim Log Structures Inc. will not be held liable for any damage or injury that may occur due to improper loading and securing of any purchased products.

Payments made on display units are non-refundable. Display Units are sold AS IS, and are a final sale.

Unit and all additional material must be fully paid for prior to leaving PacRim Log Structures Inc. at 1985 South Wellington Rd., Nanaimo, B.C., V9X 1R4.


WOOD FIRED HOT TUB TERMS & CONDITIONS

Wood Fired Hot Tub units do not come with a temperature gauge. It is the responsibility of the customer to purchase or provide a temperature gauge for this hot tub unit. It is recommended that the water temperature should not exceed temperatures greater than 104 degrees Fahrenheit, or you may run the risk of bodily harm or injury. PacRim Log Structures Inc. and associated retailers will not be held liable for failure to comply with standard temperature recommendations, for failure to purchase or use a temperature gauge, or for failure of purchaser provided temperature gauge.

The aluminum heater provided with the hot tub unit may become hot while in use. It is not recommended to store anything on top of or around this heater while in use. It is not recommended to touch any part of this heater while in use except for the appropriate door and vent handles. It is recommended to use extreme caution while this heater is in use to prevent any bodily harm or injury. PacRim Log Structures Inc. will not be held liable for any bodily harm or injury caused by this aluminum heater.

Purchaser is responsible to ensure their hot tub is kept clean and properly disinfected to prevent the spread of germs and disease. Purchaser is responsible to regularly drain water from tub and clean interior and exterior of hot tub if necessary. To ensure the water is clean and safe, the water should maintain levels of PH and disinfectant (generally chlorine). We recommend speaking to a local chemical expert to determine the proper levels of chemicals required for your hot tub. PacRim Log Structures inc. will not be held liable for failure to drain, disinfect, or clean your hot tub, nor is PacRim Log Structures Inc required to provide advice on chemical, disinfectant or PH levels required for hot tub.

It is recommended by BC Health Authorities that you should not stay in a hot tub for longer than 15 to 20 minutes at a time. It is also recommended that the soak time for children under the age of 10 years old is 5 – 10 minutes at a time, and that the temperature should not be higher than 95 degrees Fahrenheit. It is recommended that any pregnant women should consult their physician prior to using the hot tub, as well as any individuals with heart conditions, high blood pressure, or other serious medical conditions. PacRim Log Structures Inc. will not be held liable for failure to comply against local, provincial, and federal safety regulations and laws surrounding hot tubs, spas, and pool use.

PacRim Log Structures Inc. does not recommend the use of alcohol when using the hot tub and recommends proper water hydration throughout the use of the hot tub. PacRim Log Structures Inc. does not recommend the use of prescription or recreational drugs while using the hot tub. PacRim Log Structures Inc will not be held liable for failure to comply, or the misuse of drugs or alcohol when using this hot tub.

PacRim Log Structures Inc. recommends that children should always be supervised when using the hot tub, and that children should be always seated to keep their head above water. The water level should be at an appropriate level that all adults and children can sit on the hot tub seat and keep their head above water. PacRim Log Structures Inc. recommends that all areas surrounding the hot tub should be kept safe to prevent any slips or falls. Skid or slip resistant surfaces should be used in the walkways and perimeters around the hot tub, and splashing should be prevented to avoid slippery decks, patios, walk ways, etc. Hot Tub Cover should be secured when not in use. PacRim Log Structures will not be held liable for any failure to provide a safe experience while using the tub, a safe area and proximity around the tub, or safe storage of the tub when not in use.

PacRim Log Structures Inc. does not recommend diving into the hot tub as this may result in bodily harm, injury, or death. PacRim Log Structures Inc. will not be held liable for failure to comply.

 The Purchaser hereby agrees that PacRim Log Structures Inc, will not be held liable for any bodily harm, injury, or death, that may occur from failure to comply with standard local, provincial, and federal rules, regulations, laws, and safety recommendations regarding their Hot Tub or Aluminum Heater. It is the responsibility of the purchaser to be aware of all safety regulations as stated by local governing bodies, and to abide by these rules.

Regular maintenance is required for the longevity of your purchased unit. Failure to properly maintain purchased unit may void manufacturer’s warranty.

Purchaser is responsible for regular maintenance of their purchased unit and has acknowledged that PacRim Log Structures will not be held liable for failure to perform regular maintenance.

 All hot tub units will require a 50% Initial Payment prior to ordering of the unit, or placing a reserve hold on a unit In Transit. Any units that are currently In Stock require a 100% payment to purchase or reserve. The Purchaser’s unit will not be ordered or reserved until an initial payment has been received by PacRim Log Structures Inc. 

Payments for all material are to be paid directly to PacRim Log Structures Inc. through the form of: Personalized Cheque, Cash, Credit Card, Interac Debit, or Money Order. A receipt of payment will be issued to The Purchaser upon each payment.

The Purchaser is responsible to secure the unit and/or material safely and accurately into/onto their vehicle of choice, prior to leaving PacRim Log Structures Inc. property. PacRim Log Structures Inc. will not be held liable for any damage or injury that may occur due to improper loading and securing of any purchased products.

 PacRim Log Structures Inc. cannot hold units for customers on our property for periods of time longer than 30 days, and as such will not be held liable for any damages that occur while in our possession.

REFUNDS 

There will be no refunds on unit or materials once a package has been opened or installed by customer, or material has been installed, cut, or altered in any way that would deem this material unfit to resell or reuse. 

Refunds or return of payment are offered on in-stock items (as long as the item is still in PacRim possession), and regular stock items that are in-transit, as long as order placed was not a special order as requested by customer, outside of PacRim Log Structure’s typical ordering trends. 

Purchaser is responsible for notifying PacRim Log Structures of any cancelations of their unit and/or material packages. PacRim Log Structures will not be held liable for failure to communicate cancelation request by Customer. There will be no refund of payment on special order products, before or after production or ordering, including hot tubs, pre-fabricated kits, metal or shingle roofing packages, insulation or base material packages, or any other additional material package as requested by customer.

There will be no refund of payments made on any custom order once submitted for production, or ordered from the factory. 


LUMBERJACK PRODUCTS – TERMS & CONDITIONS

‘Lumber Jack Distributors Canada’ products are here by referred to as “LUMBER JACK” products. These items include, but are not limited to: ASMOKE Pellet Grill, QFlame Patio Heater, Qubestove Pizza Oven, Flame Genie Fire Pit, Lumber Jack Charcoal, Lumber Jack 100% BBQ Grilling Pellets, Sucklebusters Brine, La Croix Sauces. 

It is responsibility of the Purchaser to ensure all bylaw requirements are met through the local municipality of where the product will be used. PacRim Log Structures Inc. will not be held liable for failure to comply with local building codes or bylaws. PacRim Log Structures is not authorized, nor responsible or liable for, to provide advice on bylaws.

Any Lumberjack product is warrantied by LumberJack Distributors Canada, or their third-party supplier. Warranty items are on a case-by-case basis. More information on Lumber Jack’s warranty policy can be found here. There will be no warranty from PacRim Log Structures on Lumber Jack products.

All products will require a 100% payment to purchase. PacRim Log Structures does not offer partial payments on LumberJack products. Payments for LumberJack products are to be paid directly to PacRim Log Structures Inc. through the form of: Personalized Cheque, Cash, Credit Card, Interac Debit, or Money Order. A receipt of payment will be issued to The Purchaser upon each payment.

PacRim Log Structures will not be held liable for delay in shipment times due to unforeseen circumstances that are out of the control of PacRim Log Structures. A representative of PacRim will communicate with Purchaser as per information provided to PacRim as PacRim deems necessary.

PacRim Log Structures will not be held liable for consequential damages. 

There will be no refunds on unit packages or materials once a package has been opened or used by customer in any way that would deem this material unfit to resell or reuse.
